Do I Need Permission - Ask An Expert

Hi, im looking to put up an amateur radio antenna in my garden. It would have one cetnral support from a black fibreglass pole which is 33ft high, 50mm diamater at the base going down to 3mm at the tip, coloured black. With wiring and cabling/guying ropes coming off from the support angled towards the ground. I live in an end terrace in a new housing development in Inverness.

  1. Hi Adrian.

    This would likely come under class 3B in the permitted development rights which is “The carrying out of any building, engineering, installation or other operation within the curtilage of a dwellinghouse for any purpose incidental to the enjoyment of that dwellinghouse.”

    This allows items to be carried out without the need to apply for planning permission as long as they meet the following criteria.

    (a) any part of the development would be forward of a wall forming part of the principal elevation or side elevation where that elevation fronts a road;
    (b) any resulting structure would exceed 3 metres in height;
    (c) as a result of the development the area of ground covered by development within the front or rear curtilage of the dwellinghouse (excluding the original dwellinghouse and any hard surface or deck) would exceed 50% of the area of the front or rear curtilage respectively (excluding the ground area of the original dwellinghouse and any hard surface or deck);
    (d) it would be within a conservation area or within the curtilage of a listed building.

    As the antenna would be over 3m in height you would require to apply for planning permission.
