Do I Need Permission - Ask An Expert

I have had a coffee shop on Byres Rd Glasgow for the past 12yrs and have 2 small tables and chairs outside,the other day had a council official challenge me for a seating permit for these seats and tables which I have never had neither realised I needed,can I challenge this with the above certificate as in my 12yrs have never been asked by anyone for this permit and have read that after 10yrs it could become lawful or does this not apply to such an issue?

    Hello Lesley.

    This is slightly different you would apply for a certificate of lawfulness if it was development that had been carried out without applying for planning permission.

    Even if you had planning permission for this it is likely you would still require to apply for a permit also. This will probably be granted for a few years before requiring to be renewed.

    It may be worth speaking to you local council licence and permit department to find out more.
