Change of Use for a Driving Range

Hi,

Plans have been submitted to my council to build a driving range in a local park. In the past there was a council run pitch and putt in this park and as such the application is not being considered as a change of use. However, the pitch and putt has not been in operation for a period of in excess of 10 years, and all associated buildings etc were also removed in excess of 10 years ago. Given that there has been no pitch and putt on this site for at least 10 years and the space is now a park, is it correct that this is not being classified as a change of use?

    Although the land has not been used the classification of the land would still remain. Most likely this is currently class 11 for assembly and leisure.

    There are references in the planning legislation where land has been used for a purpose that permission has not been granted for a period of 10 years becomes lawful in terms of planning. However in this case someone would of had to apply to change the use of the land from the previous use for the class 11.
