Decking Planning Permission

I have existing decking that has been there for more than 4 years and the council tell me that it does not come under planning as it has been there for that time.
However if I decide to move it it then counts as a new build and would need planning permission.
Is this correct ?

    For it to be classed as permitted development it (not needing planning permission) the deck has to meet certain criteria.

    The deck is lower than 0.3 metres from existing ground level.
    For a terrace or semi-detached house under 16 metres sq or 10% of the original property footprint up to a maximum of 30 metres sq.
    For a detached house under 24 metres sq or 20% of the original property footprint up to a maximum of 30 metres sq.
    The area of the deck is under 30% of the total garden area. (front and rear gardens)
    No part of the deck is closer to the road than the original house unless the deck is more than 20 metres away from the road.
    Is NOT in a conservation area.
    Is NOT a listed building.
