Do I Need Permission To Form An Ensuite

Do I Need Permission - Ask An Expert I am in the process of trying to purchase a house in NE scotland but the owner installed a ensuite he does not have any council paper work. Do you need permission and building warrant. Or did he not need permission like he says???????

    Afternoon Di,

    The formation of an ensuite would have required a Building Warrant, due to changes in plumbing, ventilation etc. However, it is not uncommon for this type of work to be done without a Building Warrant approval. In the majority of cases a retrospective application called a ‘Letter of Comfort’ can be obtained from the Council without too many issues, on the proviso the work is up to standard.

    In terms of planning permission, generally this would not be required unless the property was a listed building and/or additional/new windows were being installed and then it would be worth checking with the Council.

    Unfortunately, the Council works to their own timeframes, which tend to be slower than your requirements and it is not uncommon for buyers to withhold a financial sum back from the seller until this has been fully resolved – worth speaking to your solicitor regarding this.
