Do I Need Permission - Ask An Expert We are currently selling our house and our buyer’s solicitor has asked for a letter of comfort from our council re a garage that has been in place for approx 30 years and flooring that has been installed in our loft space. We bought the house 12 years ago and both these amendments were in place when we bought the property. The solicitor is not willing to accept indemnity insurance and we would like to know where we stand with this.

    Hi Julie.

    Is it just flooring onto to roof ceiling timbers that have been installed? This seem a bit extreme for someone to ask for a letter of comfort for this.

    Current regulation you need a lot of insulation in a roof space and this generally ends up covering the roof timbers making it not possible to install flooring for storage however if this was done over 30 years ago it wouldn’t of been and issue.

    I would be surprised if building control would give you a letter of comfort for this type of alteration.

    The garage you can build a garage on your property without the need for a building warrant as long at it meets the following criteria.

    •NOT more than 30 square metres. (e.g. 5 metres by 6 metres)
    •Does NOT contain any solid fuel, oil or gas appliances.
    •Does NOT contain any sanitary accommodation.

    Your local council may give you a letter of comfort for this. You can find details on how to apply for this on your local councils website in the building control section. They will charge you a fee for this.

    Thank you for replying. It is just flooring put onto the roof timbers in the loft space.The garage meets those conditions so looks like a building warrant isn\’t required but a letter of comfort will be required before the sale can go through.
