Do I Need Permission - Ask An Expert Hi,
I have been trading with my mobile catering van in the same lay-by for nearly 2 years now and following a complaint I have been contacted from the Planning Department saying I need Planning Permission for change of land use.
I asked when I got my License and was told by the council that I didn’t need any Planning Permission as I take the van away after trading each day.
Do I need to apply for planning permission?

    Hi Mark.

    This will probably come under “Class 15” which reads,

    The use of land (other than a building or land within the curtilage of a building) for any purpose, except as a caravan site or an open air market, on not more than 28 days in total in any calendar year, and the erection or placing of moveable structures on the land for the purposes of that use.

    I have came across this before and the catering van had to apply for permission which they got on a temporary basis. e.g. they were granted the permission for 2 years and after that they had to re apply.

    I would recommend having a chat with the local council planner and find out what their thought are on it before you make an application. Ask if there is an issue with the site being use or is it just that someone has highlighted this to them and they need to ensure the correct permission are in place.
