Do I Need Permission - Ask An Expert Hi

I would like to enquire if planning permission is required when converting a flat garage roof to a single pitch roof. This is an addition at the highest point (which is on a boundary line with the next door property) from 2750mm to 3650mm. The original roof/garage has been in existence for in excess of 28 years. Initial work has begun on this addition of 900mm to the height and now the bordering neighbor has expressed concerns over the added height and resulting shade to his property. Should planning permission be required for this project.

    Hello Ricky. Anyone can normally alter, maintain or improve a building in their curtilage (i.e. garden) without the need for a planning application, unless certain specified limitations are exceeded. In the situation that you are describing these would be if the height of the eaves would exceed 3 metres; any part of the development would exceed 4 metres in height; or any part of the development within 1 metre of the boundary of the curtilage of the dwellinghouse would exceed 2.5 metres in height. From what you are saying, even though the maximum height will not exceed 4 metres, the height at the boundary will exceed 2.5 metres (it already was if it was 2.75 metres but you are increasing it to 3.65 metres). If any of the limitations are exceeded then an application for planning permission should have been submitted. It does therefore appear that the development that you are undertaking might be unauthorised (and potentially liable to the talking of enforcement action by the Council). My advice would be to stop work and contact the Council as soon as possible. They will be able to have someone check and let you know whether you need to apply for retrospective planning permission.
