    Evening Lynette,

If the total height of the fence is over 2metres off natural ground level (for ease – just measure height from your garden adjacent to the fence) the fence will require planning permission. If it is 2metres or less, in order to accurately advise I will require additional information and if so, I am happy for you to email me direct.

If the fence is over 2metres and your neighbour has already erected the fence, you can contact the Aberdeenshire Planning Enforcement Officer who will investigate and come to a formal conclusion on behalf of the Council. Which is likely to be that it would require planning permission – this would not require him to take the fence down immediately, as the Council first step would be to seek a retrospective planning application, which as a neighbour you would be notified of and could make a representation to.

Hope this helps, but happy to provide further advice if required.
