Hello Mark. Technically they can give it planning permission, provided that it complies with the development plan policies, but that does not mean that they can then go ahead and build it. Planning and civil (i.e. legal) issues are separate matters and the latter cannot be taken into account when making a decision on the former. You would need to give you permission to enable the permission to be implemented. If you didn’t, it would lapse after 3 years. Mike
