Question about patio and summerhouse

Do I Need Permission - Ask An Expert My neighbour has built a large summer house in the middle of their back garden and also built extended their patio out so that they now have 2 levels to their garden instead of 3. This required embankment work to level it off building up 2 ft and out about 5. Would they need planning permission and should I have been informed.

    Thanks for your question.

    You can build a summer house in your garden as long as it meets this criteria.

    •NOT used as a bedroom.
    •Is located to the rear of the property.
    •Does NOT exceed 4 metres in height (3 metres to eaves)
    •Any part of the building within 1 metre of the boundary does NOT exceed 2.5 metres in height.
    •The building footprint is NOT greater than 50% of the properties outside space.
    •Is NOT in a conservation area, unless it is under 4 metres sq.
    •Is NOT within the boundary of a listed building.
    •Is NOT part of a flat, apartment, or tenement.

    If the building meets this criteria they would not of required planning permission, if it doesn’t meet this planning would of been required and you should of been notified of any application.

    The patio is a bit harder to give you an answer on without know the particular project but in similar situations with decking where you raise a deck more than 500mm from ground level you need planning permission. This can be affected by other elements including the distance from boundary etc…

    If the fill works have significantly increased the height of the ground next to your boundary and you feel your privacy is affected it may be worth speaking to your local planning enforcement officer.
