Summerhouse in walled garden

Do I Need Permission - Ask An Expert We own a walled garden several miles away from our home. We are renovating this previous Victorian kitchen garden and making it into an ornamental garden. We would like to put a summerhouse or shed in here for us to use as we spend considerable amounts of time here and need somewhere to escape the weather. This garden is listed as it was part of the original big house which is listed. Do we need planning permission for this and if so would we get it? The garden itself is in green belt territory. Any help would be fantastic. Thank you

    Hello Susan.

    As there is no dwelling house on this land house holder permitted development rights wouldn’t apply. There are permitted development rights for agricultural land however where it is within the curtilage of a listed building or structure there are no right to put on sheds or out buildings.

    You would therefore require to apply for listed building consent and possibly planning permission for a summerhouse or out building.

    Did the walled garden have any existing out buildings or green houses? You may find it easier if you are putting something in the location of an existing out building or recreating an original greenhouses etc… you reasoning for requiring the building would be to allow for the restoration and upkeep of a listed structure.

    Many thanks for your reply which confirmed my fears. We have just renovated the old Victorian greenhouse which was almost derelict. The place we would like to put a summerhouse has never had a building in it. So my understanding of what you are saying is that we cannot put up a summerhouse or shed without listed building consent and possibly planning permission. Thanks again, that was very helpful.

    It might sound a lot more complicated than it is.

    It will come down to your local planning department but if I was asked to do an application for something like this based on the information you have gave me I wouldn’t see any issues with getting approval for an out building.

    As the walled garden and original house aren’t linked any more there is a good reason for providing some form of secure storage and shelter to allow the upkeep and protect the original structure.
